Terms of Service
These Terms apply to short-drama mini program services provided by One Smart Technology Company Limited (“OneSmart”, “we”, “us” or “our”). They intentionally do not use a specific app name. By accessing or continuing to use a service, you agree to these Terms and the Privacy Policy.
1. Agreement to the Terms
These Terms form a contract between you and One Smart Technology Company Limited regarding the mini program and its related content, functions and services (collectively, the “Services”). If you do not agree, do not use the Services. You must have the legal capacity to enter into this agreement. Minors may use the Services only with the involvement and consent of a parent or guardian where required.
2. Access to and Changes in the Services
We grant you a limited, revocable, non-exclusive and non-transferable licence to access the Services for personal, non-commercial use. We may add, modify, suspend or discontinue features for operational, technical, compliance or content reasons. We will provide reasonable notice where a change materially affects your rights, where required by law.
3. Accounts and Security
Some features may rely on an account from the mini program's hosting platform. You must provide accurate information and keep your account and device secure. You may not sell, lend or otherwise transfer an account. Tell us promptly if you suspect unauthorised use. To the extent permitted by law, you are responsible for loss caused by failing to protect your credentials or device.
4. Content, Purchases and Refunds
The Services may offer free or paid content. Prices, access rights, validity periods and payment methods are shown at purchase. Payments are processed by the platform or an authorised payment provider. Digital content may be delivered immediately once unlocked. Refunds are handled under the purchase information, platform rules and applicable consumer law. Contact us about duplicate charges, non-delivery or other order problems.
5. Acceptable Use
You must not:
- Use the Services for unlawful, fraudulent, harassing, infringing or unsafe activity;
- Circumvent payments, access controls, content protection or technical limits;
- Copy, record, distribute, sell, scrape or reverse-engineer content except where law expressly permits;
- Upload malicious code, disrupt systems, probe vulnerabilities or access accounts or data without authorisation;
- Impersonate another person, create fraudulent transactions or manipulate engagement;
- Infringe intellectual property, privacy, reputation or other rights.
6. Intellectual Property
Short dramas, video, audio, text, visual design, trademarks, software and other materials in the Services are owned by us or the relevant rights holders and are protected by intellectual-property law. These Terms do not transfer ownership to you. Apart from temporary use necessary for personal viewing, you may not reproduce, adapt, publicly communicate or commercially exploit materials without written permission.
7. User Content and Feedback
If a feature allows you to submit comments, feedback or other content, you must have the rights needed to submit it and it must be lawful and non-infringing. You grant us a licence to process, display and moderate that content only as reasonably necessary to operate and improve the Services. We may restrict or remove content that violates law, platform rules or these Terms.
8. Third-Party Services
The Services may integrate hosting platforms, payment providers, advertising, analytics or other third-party services. Independent third-party products are governed by their own terms and policies. We select partners with care but are not responsible for independent conduct outside our reasonable control.
9. Disclaimers
We use reasonable care to provide the Services, but network conditions, devices, platform policies, force majeure or third parties may cause delay, interruption or errors. To the maximum extent permitted by law, the Services are provided “as is” and “as available”, without warranties beyond those expressly stated or required by law. Nothing in these Terms excludes mandatory consumer rights.
10. Limitation of Liability
To the extent permitted by law, we are not liable for indirect, incidental, special or consequential loss. Our aggregate liability is limited to the amount you paid in connection with the event giving rise to the claim or the minimum amount required by applicable law, whichever is greater. No limitation applies where liability cannot legally be limited.
11. Indemnity
To the extent permitted by law, you agree to be responsible for reasonable losses and costs arising from your unlawful use of the Services, infringement of another person's rights or material breach of these Terms.
12. Suspension and Termination
We may suspend or terminate access where you materially violate these Terms, law or platform rules, or where the Services face a serious security or compliance risk. We will provide notice or an appeal route where required. You may stop using the Services at any time and may request account closure where that function is available. Provisions that by nature should survive termination will continue to apply.
13. Governing Law and Disputes
These Terms are governed by the laws of the Hong Kong Special Administrative Region, without reducing rights granted by mandatory consumer law in your place of residence. We encourage you to contact us first to resolve any concern. If a dispute cannot be resolved, it will be submitted to the courts of competent jurisdiction in Hong Kong unless mandatory law requires otherwise.
14. Changes to These Terms
We may update these Terms for legal, functional or business reasons. We will provide reasonable notice of material changes through the mini program or another appropriate channel. Continuing to use the Services after the revised Terms take effect indicates acceptance; if you do not agree, stop using the Services.
